1. Acceptance of Terms
By accessing or using the BOOTH platform, website (boothapp.co), mobile applications, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Booth, Inc. (“BOOTH,” “we,” “our,” or “us”). If you do not agree to these Terms, you may not use the Platform.
2. Description of Service
BOOTH is a marketplace that connects barbershop owners with barbers seeking chair or booth rental opportunities. We facilitate discovery, communication, booking, and payment between parties. BOOTH is not a party to any rental agreement, employment relationship, or contractor arrangement between users. We do not own, operate, or manage any barbershop listed on the Platform. All rental terms, conditions, and disputes are between the shop owner and the barber.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
4. User Accounts
- You must provide accurate, current, and complete information during registration and keep it updated
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
- You must notify us immediately at contact@boothapp.co if you suspect unauthorized access to your account
- One person or business entity may not maintain more than one account without prior approval
- We reserve the right to reclaim or reassign usernames or account identifiers at our discretion
5. User Conduct
You agree not to:
- Provide false, misleading, or fraudulent information in your profile, listings, or communications
- Violate any applicable local, state, national, or international laws or regulations
- Discriminate against any user on the basis of race, color, religion, sex, national origin, disability, or any other protected characteristic
- Harass, threaten, or abuse other users through messages or any other means
- Use the Platform to solicit users for transactions outside of BOOTH in order to avoid Platform fees
- Scrape, crawl, or use automated means to access the Platform or extract data
- Attempt to gain unauthorized access to our systems, other user accounts, or data
- Upload content that is illegal, harmful, defamatory, or infringes on intellectual property rights
- Interfere with or disrupt the integrity or performance of the Platform
6. Shop Owner Responsibilities
If you list a shop or booth on the Platform, you agree to:
- Provide accurate and up-to-date listing information, including pricing, availability, amenities, and photos
- Maintain a safe, clean, and lawful workspace that complies with all applicable health, safety, and licensing requirements
- Honor confirmed bookings and communicate any changes promptly
- Ensure you have the legal right to offer booth or chair rental at your location
- Set your own pricing and rental terms in compliance with applicable laws
7. Barber Responsibilities
If you use the Platform as a barber, you agree to:
- Hold any licenses or certifications required by your jurisdiction to practice barbering
- Respect the shop’s rules, policies, and workspace upon arrival
- Honor confirmed bookings and communicate any cancellations in advance
- Maintain appropriate professional liability coverage where required by law
8. Payments, Fees, and Payouts
All payments on the Platform are processed securely through Stripe. By using the Platform, you agree to the following:
- Barbers agree to pay all fees associated with their booth rental bookings as displayed at the time of booking
- Shop owners receive payouts through Stripe Connected Accounts, subject to Stripe’s terms and processing timelines
- BOOTH may charge a platform service fee on transactions, which will be clearly disclosed before payment
- Fees are non-refundable unless otherwise stated in our refund policy or required by applicable law
- You are responsible for any taxes arising from your use of the Platform, including income tax on earnings
- BOOTH is not responsible for delays, holds, or issues caused by Stripe or your financial institution
9. Cancellations and Refunds
Cancellation and refund policies may vary by listing and are set by the shop owner. BOOTH encourages all users to communicate promptly about cancellations. In the event of a dispute, BOOTH may mediate at its discretion but is not obligated to issue refunds on behalf of either party. Any refund issued by BOOTH is made as a courtesy and does not establish a precedent or obligation.
10. Intellectual Property
The BOOTH name, logo, brand assets, website design, software, and all related content are the exclusive property of Booth, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any BOOTH materials without prior written consent. Content you upload to the Platform (such as photos, descriptions, and profile information) remains yours, but you grant BOOTH a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Platform.
11. Limitation of Liability
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, BOOTH disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. BOOTH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. We do not guarantee the quality, safety, legality, or suitability of any booth rental, shop, or barber found through the Platform. Our total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the total fees you have paid to BOOTH in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Booth, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any rental arrangement or dispute between you and another user.
13. Dispute Resolution
Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Chicago, Illinois. You agree to waive any right to a jury trial or to participate in a class action. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
14. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Platform, or for any other reason at our sole discretion. You may also delete your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately, but provisions that by their nature should survive (including limitation of liability, indemnification, and dispute resolution) will remain in effect.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email or through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform.
